Private right of action
The right of an individual, such as an applicant, to sue directly for a violation.
Where a law grants a private right of action, applicants or employees can bring claims themselves instead of waiting for a state agency to act. This tends to raise the practical risk of a non-compliant posting.
Other laws are enforced only by a state agency, typically through complaints, warnings and fines.
